About These Terms

These Terms of Sale are intended to provide a clear understanding of what you can expect when purchasing from Studio Apure and what we ask of you as our customer. They explain how orders are accepted and processed, how payments and deliveries are handled, and what happens if an order must be changed, canceled, returned, or refunded.

We have included these terms to help avoid misunderstandings and ensure that every order is handled fairly and consistently. They also allow us to protect the quality and integrity of our products while respecting the consumer rights available to you under applicable law.

Please review these Terms of Sale before placing an order. If you have questions about a product, delivery, warranty, return, or international order, we encourage you to contact Studio Apure before completing your purchase.

These Terms of Sale apply to purchases made directly from Studio Apure, LLC through studioapure.com. By submitting an order, you acknowledge that you have reviewed and agreed to these Terms of Sale, our Return and Refund Policy, Limited Warranty, Privacy Policy, and any additional terms presented during checkout.

Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded under applicable law.

1. Payment Methods

Studio Apure, LLC accepts major credit cards and other payment methods displayed at checkout through Shopify’s secure payment gateway. Full payment is required when an order is placed unless otherwise stated in writing.

Payments are processed through Shopify Payments or another authorized third-party payment provider. Studio Apure, LLC does not directly store complete payment card information, as payment transactions are managed by the applicable payment provider.

By placing an order on studioapure.com, you authorize Studio Apure, LLC and its payment providers to charge your selected payment method for the full order amount, including applicable taxes, shipping charges, duties, and any other charges disclosed at checkout.

Fraud prevention and security tools are used to protect Studio Apure and its customers. Orders may be reviewed, delayed, declined, or canceled if fraud, unauthorized activity, inaccurate information, payment irregularities, or other security concerns are reasonably suspected. Studio Apure, LLC may request additional information to verify an order.

Payments made through third-party processors, such as PayPal, are also subject to the terms and privacy practices of those providers.

Unless otherwise displayed at checkout, all prices and payments are stated in U.S. dollars. Currency conversion charges, foreign transaction fees, and similar fees imposed by a bank or payment provider are the customer’s responsibility.

2. Pricing, Taxes and Errors

Product prices are those displayed on studioapure.com at the time an order is submitted, subject to confirmation and acceptance by Studio Apure, LLC.

Applicable sales taxes and similar transaction taxes are calculated at checkout when required based on the shipping destination. Customers remain responsible for any taxes, duties, or government charges that are not collected by Studio Apure, LLC but are legally payable by the customer.

Prices, product information, availability, specifications, and promotions may be changed or discontinued without notice before an order is accepted.

Studio Apure, LLC reserves the right to correct pricing, promotional, descriptive, or typographical errors. If an error affects an order that has already been submitted, Studio Apure, LLC may contact the customer to confirm the corrected information or cancel the affected portion of the order and issue a refund.

Studio Apure, LLC is not responsible for additional compensation or damages resulting from a pricing, promotional, descriptive, or typographical error, except where otherwise required by applicable law.

3. Order Confirmation and Acceptance

An order confirmation acknowledges that Studio Apure, LLC has received the order. It does not necessarily constitute final acceptance of the order.

An order is accepted when Studio Apure, LLC sends a shipping confirmation, expressly confirms acceptance in writing, or otherwise begins fulfillment, whichever occurs first.

This process allows Studio Apure to verify product availability, payment information, shipping eligibility, and order accuracy before confirming that the purchase can be fulfilled.

Studio Apure, LLC may reject or cancel an order before acceptance because of product unavailability, payment issues, suspected fraud, incorrect pricing or product information, shipping restrictions, quantity limitations, or other legitimate business reasons.

If a paid order is canceled, the applicable amount will be refunded to the original payment method.

4. Order Changes and Cancellations

Customers should request an order cancellation or modification as soon as possible through the messenger or contact options available on studioapure.com.

Studio Apure, LLC cannot guarantee that an order can be changed or canceled after it has been submitted. Once an order has entered processing, production, or shipment, no further changes may be possible, and the applicable Return and Refund Policy will apply.

Custom, personalized, engraved, made-to-order, limited-allocation, or final-sale products may not be canceled or returned except where required by law or expressly permitted by Studio Apure, LLC in writing.

5. Product Availability and Backorders

Product availability is not guaranteed until an order has been accepted by Studio Apure, LLC.

If an item becomes unavailable, the customer may be offered an estimated lead time, an alternative product, a partial shipment, or a refund for the unavailable item.

Estimated availability and restocking dates are provided in good faith but are not guaranteed. Studio Apure, LLC will provide any notice, cancellation option, or refund required under applicable law.

6. Shipping and Delivery

Available shipping methods, estimated delivery periods, and applicable shipping charges will be displayed at checkout or otherwise communicated before shipment.

Shipping costs are the customer’s responsibility unless otherwise specified at checkout.

Delivery dates and transit times are estimates unless Studio Apure, LLC expressly agrees to a guaranteed delivery date in writing. While Studio Apure makes every reasonable effort to meet the estimated delivery period, circumstances involving carriers, customs authorities, severe weather, transportation interruptions, or other events outside Studio Apure’s reasonable control may cause delays.

If Studio Apure, LLC cannot ship within the timeframe stated at the time of purchase, the customer will be provided with any notice, consent request, cancellation right, or refund required under applicable law.

The customer is responsible for providing a complete and accurate shipping address. Additional shipping, storage, redelivery, or return costs caused by an inaccurate address, unsuccessful delivery attempt, failure to collect a shipment, or unjustified refusal of delivery may be charged to the customer where permitted by law.

Tracking information will generally be provided after an order has shipped.

7. Transfer of Ownership and Risk of Loss

For consumer orders, risk of loss or damage remains with Studio Apure, LLC until the order is delivered to the customer or to a person designated by the customer, except where applicable law provides otherwise.

When a customer independently selects or appoints a carrier that was not offered or arranged by Studio Apure, LLC, risk may transfer when the goods are delivered to that carrier to the extent permitted by applicable law.

Ownership of the products transfers to the customer after full payment has been received and the products have been delivered, except where applicable law provides otherwise.

Customers should inspect packages promptly upon delivery. Visible shipping damage, missing products, or delivery discrepancies should be reported to Studio Apure, LLC as soon as reasonably possible, preferably within five calendar days of delivery. Photographs of the product, shipping carton, packaging materials, and shipping label may be required.

Failure to report an issue within this requested period does not waive any consumer right that cannot legally be waived.

8. Product Information and Use

Studio Apure, LLC makes reasonable efforts to display product colors, finishes, dimensions, specifications, and images accurately. Screen settings, lighting conditions, material characteristics, and reasonable manufacturing tolerances may result in variations.

Customers must read and follow all product instructions, warnings, charging requirements, care instructions, and safety information provided with the product or made available by Studio Apure. Following these instructions helps ensure proper performance, safe operation, and continued warranty eligibility.

Products must be used only for their intended purpose and in the manner directed by Studio Apure. Customers are responsible for ensuring that products are operated, charged, stored, maintained, and transported in accordance with all applicable instructions and warnings.

Only compatible chargers, cords, power supplies, accessories, replacement parts, and components approved or recommended by Studio Apure should be used with the product. Products must not be modified, disassembled, repaired, altered, or used with unauthorized components except by Studio Apure or an authorized service provider.

To the fullest extent permitted by applicable law, Studio Apure, LLC is not responsible for damage, loss, malfunction, reduced performance, personal injury, or property damage caused by or resulting from misuse, abuse, neglect, improper charging, improper storage, improper maintenance, unauthorized repair or modification, use with incompatible or unauthorized accessories or power sources, exposure to unsuitable environmental conditions, or failure to follow product instructions, warnings, or safety guidelines.

Damage resulting from improper use, unauthorized modification, accident, neglect, normal wear and tear, or failure to follow the product instructions may be excluded from return eligibility and warranty coverage to the extent permitted by applicable law.

Customers must discontinue use immediately if a product appears damaged, operates abnormally, becomes excessively hot, emits an unusual odor, or otherwise presents a potential safety concern. Customers should disconnect the product from its power source where it is safe to do so and contact Studio Apure at through our contact form for assistance.

Customers purchasing products for use outside the United States are responsible for confirming local voltage, plug, frequency, labeling, installation, and regulatory compatibility before completing the purchase.

Nothing in this section excludes or limits liability for a product defect, an inadequate warning, or any responsibility that cannot legally be excluded or limited under applicable law.

9. Return and Refund Policy

Returns, exchanges, and refunds are governed by the Studio Apure Return and Refund Policy available through the Studio Apure returns portal. That policy is incorporated into these Terms of Sale.

The return requirements help ensure that returned products are complete, properly inspected, and suitable for resale while allowing eligible customers to return a purchase within the applicable return period.

Unless otherwise required by law, return shipping costs are the customer’s responsibility except where prepaid return coverage was purchased or Studio Apure, LLC confirms that the product arrived damaged, defective, or incorrect.

A Return Processing Fee of up to $35 per returned item may apply to preference-based returns, as specified in the Return and Refund Policy in effect when the order is placed. This fee helps cover the administration, inspection, testing, repackaging, and restocking associated with returned products.

Any applicable Return Processing Fee will be disclosed before purchase or stated in the applicable Return and Refund Policy. Studio Apure, LLC may waive or reduce the fee depending on the circumstances of the return. A decision to waive or reduce the fee for one return does not require Studio Apure, LLC to do so for another return.

The Return Processing Fee will not apply to a product confirmed by Studio Apure, LLC to have arrived damaged, defective, or incorrect. The fee will also not apply where prohibited by applicable law.

Once a returned product has been received and inspected, an approved refund will generally be initiated to the original payment method within 10 business days.

Any applicable Return Processing Fee, non-refundable shipping charge, or other deduction permitted under the Return and Refund Policy or applicable law will be deducted from the refund.

The customer’s bank or payment provider may require additional time to post the refund to the customer’s account.

If a returned product does not meet the applicable return conditions, the refund may be denied, delayed, or adjusted. The customer will be notified if an issue is identified during inspection.

10. Exchanges

Eligible exchanges must be requested within the exchange period stated in the Studio Apure Return and Refund Policy and must be processed through the Studio Apure returns portal.

Exchanges are subject to product availability and the same product condition, packaging, accessory, and documentation requirements that apply to returns.

If a replacement product has a different price, the customer may be required to pay the difference or may receive a refund for the difference, as applicable.

11. Limited Warranty

Products purchased directly through studioapure.com are covered by the Studio Apure Limited Warranty applicable to the product at the time of purchase.

The Limited Warranty explains the applicable warranty period, what is covered, what is not covered, the remedies that may be available, and how to submit a claim.

Any voluntary Limited Warranty provided by Studio Apure is in addition to statutory consumer rights that cannot legally be limited or excluded.

Warranty coverage for products purchased from an authorized Studio Apure retailer or reseller may require proof of purchase from that seller and may be administered through the seller or Studio Apure, LLC as stated in the applicable warranty.

12. Items Purchased Through Retailers or Resellers

Products purchased through an authorized Studio Apure retailer or reseller are subject to that seller’s return, refund, and exchange policies.

Studio Apure, LLC cannot process returns, refunds, or exchanges for purchases made through third-party retailers or resellers unless Studio Apure expressly agrees otherwise in writing or applicable law requires otherwise.

Warranty support for products purchased through an authorized retailer or reseller will be handled in accordance with the applicable Studio Apure Limited Warranty.

13. International Shipping

Studio Apure, LLC ships to eligible international destinations, with available shipping methods and fees displayed at checkout.

International shipments may involve local customs procedures, inspections, documentation, and charges established by the destination country. These requirements and charges are not controlled by Studio Apure.

Unless checkout expressly states that duties and taxes are included, the recipient is responsible for all customs duties, import taxes, brokerage charges, clearance fees, and other charges assessed by the destination country.

The customer may be treated as the importer of record and is responsible for providing any information required for customs clearance and complying with applicable import requirements.

Studio Apure, LLC is not responsible for customs delays, governmental inspections, or lawful decisions made by customs or other government authorities.

If an international shipment is refused, abandoned, or returned because duties were not paid, required clearance information was not provided, or delivery was declined, Studio Apure, LLC may deduct the resulting shipping, customs, brokerage, storage, and return costs from any refund where permitted by law.

International return shipping costs are the customer’s responsibility unless otherwise specified or required by applicable law.

Studio Apure, LLC does not ship to destinations or persons prohibited by applicable export control, sanctions, or trade laws.

14. Rights of International Consumers

Customers located outside the United States may have mandatory consumer rights under the laws of their country or region. These Terms do not exclude or limit rights that cannot legally be excluded.

Where applicable law provides a statutory cancellation or withdrawal period, that period and the legally required remedies will apply.

Customer-paid return costs, deductions for diminished value, and exclusions from a statutory right of withdrawal will be determined in accordance with applicable law.

A contractual Return Processing Fee will not apply to the exercise of a statutory withdrawal right where such a fee is prohibited.

Customers in the European Union, European Economic Area, or United Kingdom may have additional rights regarding cancellation, conformity of goods, repair, replacement, price reduction, refunds, and legal guarantees. These rights may apply independently of Studio Apure’s voluntary Return and Refund Policy and Limited Warranty.

15. Customer Communications and Marketing

By placing an order on studioapure.com, the customer consents to receive transactional communications relating to the purchase, including payment confirmations, order updates, shipping notifications, delivery information, security notices, warranty communications, product care information, and customer service updates.

Where permitted by applicable law, customers may also receive occasional marketing communications from Studio Apure, including product announcements, editorial content, event invitations, special offers, and other brand updates.

Customers may unsubscribe from marketing communications at any time by selecting the unsubscribe link included in any marketing email. 

Unsubscribing from marketing communications will not prevent the customer from receiving transactional or service-related communications concerning an order, return, warranty claim, product safety matter, or customer support request.

For customers located in jurisdictions where prior consent is required, Studio Apure will send marketing communications only after receiving the consent required under applicable law.

Studio Apure, LLC will process customer contact information and marketing preferences in accordance with its Privacy Policy and applicable law.

16. Limitation of Liability

Studio Apure, LLC is not responsible for reasonable delays in order processing, shipment, customs clearance, or delivery caused by circumstances outside its reasonable control.

To the fullest extent permitted by applicable law, Studio Apure, LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to a product or purchase, including loss of use, loss of profits, or loss of business opportunity.

To the fullest extent permitted by applicable law, Studio Apure, LLC’s total liability arising from a product or order will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, personal injury, or mandatory consumer protection rights where applicable.

Nothing in these Terms eliminates any remedy expressly provided under the Studio Apure Limited Warranty or applicable law.

17. Dispute Resolution and Governing Law

Studio Apure, LLC encourages customers to contact us through the support form before initiating a formal proceeding so that Studio Apure and the customer may attempt to resolve the matter directly.

These Terms and purchases made through studioapure.com are governed by the laws of the State of Florida, without regard to conflict of law principles, except to the extent that the mandatory consumer laws of the customer’s jurisdiction apply.

Subject to applicable consumer rights and small claims jurisdiction, any judicial proceeding arising from these Terms or a purchase from Studio Apure, LLC must be brought in a state or federal court located in Miami-Dade County, Florida. Each party consents to the personal jurisdiction of those courts.

No arbitration requirement or class action waiver applies unless it is presented in a separate, legally enforceable agreement accepted by the customer.

18. Force Majeure

Studio Apure, LLC is not responsible for a failure or delay in performance caused by circumstances outside its reasonable control.

These circumstances may include natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, epidemics, pandemics, labor disruptions, governmental actions, customs restrictions, supply chain interruptions, utility failures, carrier interruptions, transportation delays, or shortages of materials or components.

This provision does not eliminate any cancellation, notice, delivery, or refund right that applies under mandatory law.

19. Amendments to Terms

Studio Apure, LLC may update or modify these Terms periodically.

Changes become effective when posted and apply prospectively to orders placed after the stated effective date.

The Terms in effect when an order is placed will ordinarily govern that order. Continued use of studioapure.com will not retroactively change the terms that applied to a previously completed purchase.

20. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent legally permitted.

The remaining provisions will continue in full force and effect.

21. Right to Refuse or Limit Service

Studio Apure, LLC may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized resale, product shortages, payment issues, incorrect pricing, shipping restrictions, abusive activity, or violation of these Terms.

Studio Apure, LLC will not refuse service on a basis prohibited by applicable law.

If a paid order is canceled by Studio Apure, the applicable amount will be refunded promptly to the original payment method.

22. Entire Agreement

These Terms of Sale, together with the applicable order details, Return and Refund Policy, Limited Warranty, Privacy Policy, and any additional terms presented at checkout, constitute the agreement between the customer and Studio Apure, LLC regarding the applicable purchase.

If there is a direct conflict between these documents, mandatory law will control, followed by any product-specific terms accepted at checkout, the applicable order confirmation, these Terms of Sale, and the incorporated policies.
